Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes uses of the [PRODUCT_NAME] service that are not allowed. It forms part of your agreement with Lemus Digital LLC ("we," "us," or "our") under the Terms of Service. By using the Service, you agree to comply with this AUP. Violation may result in suspension or termination of your account.

1. Lawful Use Only

You may use the Service only for lawful purposes and in accordance with applicable laws and regulations in your jurisdiction and in the United States. You are responsible for ensuring that your use of the Service, including the content you upload and the way you handle your clients' data, complies with all applicable laws (e.g., data protection, privacy, intellectual property, and consumer protection).

2. Prohibited Content

You may not upload, store, display, or transmit through the Service any content that:

  • Is illegal: Including content that promotes or facilitates illegal activity, or that infringes any applicable criminal, export, or other laws.
  • Exploits or endangers minors: Including child sexual abuse material (CSAM) or any content that exploits or endangers minors. We will report CSAM to the appropriate authorities and terminate accounts.
  • Is harmful or threatening: Including content that promotes violence, terrorism, self-harm, or that harasses, defames, or threatens others.
  • Infringes intellectual property or other rights: Content that you do not have the right to use (e.g., you do not own the copyright or have a license, or you are violating a third party's trademark or privacy rights). You must have appropriate rights or consents for all photos and client data you upload.
  • Is deceptive or fraudulent: Including phishing, impersonation, or scams.
  • Contains malware or harmful code: Such as viruses, ransomware, or other code designed to disrupt or gain unauthorized access to systems or data.
  • Is otherwise objectionable: We may reject content that we reasonably consider to be obscene, hateful, or otherwise inconsistent with a professional photography and client-delivery platform.

We do not actively monitor content but may review content in response to reports, to enforce this AUP, or to comply with law. We may remove content and/or suspend or terminate accounts that we reasonably believe violate this policy.

3. Prohibited Conduct

You may not:

  • Abuse the Service or other users: Attempt to gain unauthorized access to the Service, other accounts, or our or any third party's systems or networks; interfere with or disrupt the integrity or performance of the Service; or circumvent any usage limits, security measures, or access controls.
  • Use the Service for spam or unsolicited communications: Use the Service to send bulk unsolicited messages (e.g., spam) to your clients or others in a way that violates applicable anti-spam or telecommunications laws, or that we reasonably consider abusive.
  • Resell or redistribute the Service without authorization: Resell, sublicense, or offer the Service to third parties as a standalone product (e.g., "white label") unless we have agreed in writing. Using the Service to deliver your own photography services to your clients is permitted.
  • Scrape or automate without permission: Use bots, scrapers, or other automated means to access or extract data from the Service in a way that exceeds normal use or that we have not authorized.
  • Reverse engineer or attempt to extract source code: Reverse engineer, decompile, or disassemble the Service (except to the extent permitted by applicable law), or attempt to derive the source code or underlying ideas of the Service.

4. Data Protection and Your Clients

When you use the Service to store or process personal data of your clients (e.g., names, email addresses, photos), you are responsible for:

  • Having a lawful basis to collect and process that data (e.g., consent, contract, or legitimate interest under applicable law).
  • Complying with applicable data protection and privacy laws (e.g., GDPR, CCPA) in your role as data controller toward your clients.
  • Using the Service in a way that does not cause us to process personal data in violation of law or of our Privacy Policy.

You may not upload or share personal data of individuals without a lawful basis, or in a way that would violate their rights or applicable law.

5. Consequences of Violations

If we reasonably believe you have violated this AUP or our Terms of Service, we may:

  • Warn you and require you to correct the issue within a specified time.
  • Remove or disable access to specific content.
  • Suspend your access to the Service (temporarily or until the issue is resolved).
  • Terminate your account and refuse future use of the Service.
  • Report conduct to law enforcement or other authorities when we believe it is appropriate (e.g., illegal activity, CSAM).

We are not obligated to provide notice before taking action when we believe it is necessary to protect the Service, other users, or third parties, or to comply with law.

6. Reporting Violations

If you become aware of content or conduct on the Service that you believe violates this AUP, please report it to us at [EMAIL_LEGAL] or [EMAIL_SUPPORT] with a description of the content or conduct and, if possible, the relevant account or URL. We will review reports and take action as we deem appropriate, consistent with our Terms of Service and applicable law. We may not disclose the outcome of our review to the reporter for privacy or security reasons.

We may update this AUP from time to time. We will notify you of material changes by posting the updated AUP on the Service and/or by email. The updated AUP will be effective as of the date indicated. Your continued use of the Service after that date constitutes acceptance of the updated AUP. If you do not agree, you must stop using the Service and may close your account.
